OFFICIAL RULES

  These rules apply to the “Multi-Market ‘Brantley Gilbert’s Ink Some Memories in the Sand Flyaway” contest (“Contest”) conducted by Beasley Media Group, LLC d/b/a WSOC-FM, WKXC-FM, WKLB-FM, WKML-FM, KCYE-FM, WXTU-FM, and WQYK-FM (each a “Station,” collectively the “Stations”). In addition, the General Contest Rules posted at www.country1037fm.com, www.kicks99.com, www.country1025.com, www.wkml.com, www.1027coyotecountry.com, www.925xtu.com, or www.995qyk.com apply to this Contest. If there is a conflict between the General Contest Rules and the Rules for this Contest, the Rules for this Contest shall control.

1. HOW TO ENTER

a. The Contest will begin on Sunday, December 8th 2024 (for entrants in the Pacific Time (“PT”) zone) and Monday, December 9th 2024, (for entrants in the Eastern Time (“ET”) zone), and end on Friday, December 20, 2024.

b. To participate in the Contest, visit www.country1037fm.com, www.kicks99.com, www.country1025.com, www.wkml.com, www.1027coyotecountry.com, www.925xtu.com, www.995qyk.com or www.backstagecountry.com and follow the links and instructions to enter the Contest and complete and submit the online entry form beginning on Monday, December 9th, 2024, at 12:00am ET (Sunday, December 8th, 2024, at 9:00pm PT) and ending on Friday, December 20, 2024, at 11:59pm ET/8:59pm PT (“Online Entry Period”). Online entrants are subject to all notices posted online including but not limited to the Station's Privacy Policy. Limit one (1) entry per eligible person during the Online Entry Period regardless of Station website used to enter and regardless if entrant has more than one email address. Multiple entrants are not permitted to share the same email address. Entries submitted may not be acknowledged or returned. Proof of submission of an entry shall not be deemed proof of receipt by the Contest administrator.

c. There will be up to a total of one (1) Grand Prize winner selected in this multi-market Contest.  

2. ELIGIBILITY RESTRICTIONS

a. This Contest is open to all Station listeners who are 18 years of age or older as of the date of entry into the Contest, who are legal US residents and reside in the continental United States, including Washington, DC, except where prohibited by law. Winners must possess a valid, government-issued ID and show proof of residency to verify eligibility.

3. PRIZES

a. Up to one (1) Grand Prize will be awarded in the Contest. The Grand Prize is being provided by The Valory Music Co. and Sandals Resorts and consists of the following prize assets: a. Virtual Meet and Greet with Brantley Gilbert (along with a Station talent; subject to artist and talent availability)

b. The following merch items: Signed LP of Brantley Gilbert's Tattoos Album and Brantley Gilbert Flag. c. Sandals Resort All-inclusive Caribbean Vacation: 4 days, 3 nights for 2 adults (winner and one (1) guest) (Choice dates and choice of Jamaican Sandals Resort, subject to resort availability) Roundtrip airfare for 2 from area airport. This portion of the Grand Prize is defined in Schedule A.

The Approximate Retail Value (“ARV”) of the Grand Prize is $6,000.00. The winner will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of the prize(s).

Actual value may vary and any difference between stated value and actual value will not be awarded. Certain travel restrictions may apply. All other costs not specifically stated herein, including but not limited to those of, taxes, meals, tips and additional ground transportation, baggage fees, hotel room service, laundry service, alcoholic beverages, merchandise, souvenirs, and local and long-distance telephone calls are the responsibility of the winner. Selection of airline, hotel, and airline seat location at sole discretion of Station and/or prize provider. Airline regulations apply. The winner and guest must travel on the same itinerary and are responsible for obtaining all required travel documents, including, without limitation, passports for international travel. If applicable, the winner may be required to present a valid credit card upon hotel check-in to cover any incidental expenses incurred during the winner’s stay. Winner and guest must abide by all airline, hotel, and venue policies. The winner and guest must sign all required releases prior to booking of any travel. If winner is unwilling or unable to travel on the dates specified, the prize will be forfeited and may be awarded to another winner at Station’s sole discretion. All travel is subject to availability and restrictions. If a prize-related event or travel is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, including for weather, or for any reason beyond the control of the Station and prize provider, their sole responsibility to the winner will be to award the remaining available elements of the prize(s) and no substitution or compensation will be provided for the unawarded elements of the prize(s). No refund or compensation will be made in the event of the cancellation or delay of any flight. If winner chooses to take the trip without a guest, s/he will be awarded the prize elements for one person only, and the remainder of the prize will be forfeited without compensation. Winner understands that there are inherent risks involved in travel and that these risks may be present before, during and after the trip. In addition, winner and guest(s) should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before, during and after the trip. Winner will be issued a 1099 for 2024, regardless of when the winner travels on the Grand Prize trip.

b. Prizes or prize certificates must be claimed as described by the Stations at the time of winning. Prize or prize certificate must be claimed within five (5) days of winning the Grand Prize. Failure to claim Prize by the specified time will result in forfeiture of the prize. It is the winner’s sole responsibility to claim the Prize or prize certificate within the timeline provided in these Official Rules.

4. SELECTION OF WINNERS

a. Up to one (1) multi-market Grand Prize winner will be selected at approximately 12:00 PM ET/9:00 AM PT on Monday, December 23rd, 2024, in a Station-conducted random drawing from all combined eligible online entries received during the Online Entry Period on each Station’s website. Potential Grand Prize winner will be notified by phone and/or email promptly following the random drawing.

b. Odds of winning the Grand Prize depend on the number of combined eligible online entries received during the Online Entry Period on each Station’s website.

c. Entrants need not listen to the Station or be present to win.

d. Prize winner must confirm acceptance of prize within five (5) days of winning, or risk disqualification and selection of an alternate Prize winner (time permitting) in a random drawing of all remaining eligible online entries received.

e. Decisions of Station management with respect to the Contest are final.  

5. CONDITIONS

a. The Stations reserve the right to end any contest or amend these rules upon announcement on air and by publication at www.country1037fm.com, www.kicks99.com, www.country1025.com, www.wkml.com, www.1027coyotecountry.com, www.925xtu.com, or www.995qyk.com.

b. For website contests: By use of a Station’s website and by entering this Contest, entrants agree to a Station’s Terms of Service Agreement and to the use of Personal Information as stated in the Privacy Policy located at www.country1037fm.com, www.kicks99.com, www.country1025.com, www.wkml.com, www.1027coyotecountry.com, www.925xtu.com, or www.995qyk.com.

c. Copies of the written Contest rules and a list of all winners are available during regular business hours at the main studio of each Station, or by sending a self-addressed, stamped envelope to a Station.

The Sandals Resort Prize Package

Terms and Conditions

The following Terms and Conditions apply to the Sandals Resorts Prize Package and shall be inserted into the Official Rules:

1. Sandals Resorts is an all-inclusive Caribbean resort for adults.

2. Prizewinner and travel companion must be 18 years of age or older.

3. The Sandals Resorts Prize Package will include luxurious accommodations (one (1) room, double occupancy in a luxury level category room), all meals, unlimited Premium Liquors, daily & nightly entertainment, an array of land and water sports activities, including daily Scuba diving (for certified divers), snorkeling, Wi-Fi in all rooms and public areas, resort gratuities, resort taxes, and Sandals transfers to and from the selected or designated airport.

4. “Exclusions” car rental, personal charges, incidentals, telephone calls, Premium Wi-Fi, Red Lane® Spa treatments and services, specialty dining, tours & excursions, inter-island transportation, SCUBA certification courses, room services, meals outside of the selected or designated resort, island departure taxes, purchases made at the Sandals Specialty or Gift Shops, baggage fees, customs duties, and travel insurance are not included.

5. The accommodations portion of the Sandals Resorts Prize Package will be issued in the form of a prize certificate (“Prize Certificate”) outlining the terms and conditions of the prize and redemption procedures.

6. The Sandals Resorts Prize Package must be redeemed for travel within one (1) year from the date on the Sandals Resorts Prize Certificate (the “Redemption Period”) and is not transferable or redeemable for cash. No extension will be given after the Redemption Period has expired. If the Sandals Resorts Prize Package is not redeemed, the Sandals Resorts Prize Package will be forfeited.

7. The accommodations portion of the Sandals Resorts Prize Package is subject to space availability and selected blackout dates. Reservations will not be confirmed until 30 days prior to the selected travel date. Confirmation of travel dates will only be provided 30 days prior to the departure date.

8. Any federal, state and/or local taxes applicable to the Sandals Resorts Prize Package will be the prizewinner’s responsibility to pay. The Prizewinner will receive from the Sponsor or its designee an IRS Form 1099 (or similar) in the amount of the Sandals Resorts Prize Package.

9. Substitution of Resort: Unique Travel Corp - the Sandals Resorts Prize Provider and/or Sandals Resorts each reserves the right to substitute the selected resort for another resort in the resort’s chain in a similar category, and to change dates without prior notice for any circumstance(s) beyond the resort’s control based upon availability for the secured travel dates. The terms and conditions agreed to shall apply with equal applicability to any resort which is the subject of substitution or deviation. Neither Unique Travel Corp nor Sandals Resorts shall be liable for any claim made whatsoever, including but not limited to loss, compensation, or refund by reason of such substitution or deviation.

10. Compliance with Government Entities: Unique Travel Corp, its affiliates, and parent as well as Sandals Resorts and/or Sandals Resorts related entities shall have the right to comply with any and all orders, recommendations, or directions whatsoever given by any government entity or by persons purporting to act with such authority, and such compliance shall not be deemed a breach of the Agreement or any agreement entitling the guests to assert any claim for liability, compensation or refund.

11. Health and Safety: Sandals Resorts reserves the right to implement or modify health protocols, policies and procedures at any time as needed, in keeping with public health guidance and applicable law.

12. CLASS ACTION WAIVER: ACCEPTANANCE OF THE SANDALS RESORTS PRIZE PACKAGE PROVIDES FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION AND SUPERSEDES ANY LAW ENTITLING GUEST TO PARTICIPATE IN A CLASS ACTION. THIS CLASS ACTION WAIVER PRECLUDES GUEST FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING ANY CLAIM BROUGHT AS A RESULT OF THIS AGREEMENT. EVEN IF APPLICABLE LAW PROVIDES OTHERWISE, GUEST AGREES THAT ANY ARBITRATION OR LAWSUIT AGAINST UNIQUE TRAVEL CORP – THE SANDALS RESORTS PRIZE PACKAGE PROVIDER WHATSOEVER SHALL BE LITIGATED BY GUEST INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS ACTION, AND GUEST EXPRESSLY AGREES TO WAIVE AUTHORITY TO ARBITRATE CLAIMS ON A CLASS ACTION BASIS. IF GUEST'S CLAIM IS SUBJECT TO LEGAL PROCEEDING UNDER FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE UNIQUE TRAVEL CORP. - TERMS AND CONDITIONS AVAILABLE HERE https://www.sandals.com/terms-conditions/ THE GUEST FURTHER AGREES AND ACKNOWLEDGES THAT THE CLASS ACTION WAIVER IS MATERIAL AND ESSENTIAL TO THE PROCEEDING OF ANY DISPUTES BETWEEN THE PARTIES AND IS NON-SEVERABLE FROM THE AGREEMENT TO ANY CLAIMS HEREIN. THE VALIDITY AND EFFECT OF THIS CLASS ACTION WAIVER MAY BE DETERMINED ONLY BY A JUDGE OR COURT OF LAW. GUEST AGREES THAT THIS SECTION SHALL NOT BE SEVERABLE UNDER ANY CIRCUMSTANCES FROM THE FORUM SELECTION AND CHOICE OF LAW PROVISION SET FORTH IN THE UNIQUE TRAVEL CORP. – TERMS AND CONDITIONS. GUEST AGREES THAT THE PARTIES REFERENCED IN FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE UNIQUE TRAVEL CORP. – TERMS AND CONDITIONS THAT MAY BE THE SUBJECT OF ANY CLAIM BY GUEST CAN RECEIVE IMMEDIATE JUDICIAL ASSISTANCE TO ENFORCE THIS CLASS ACTION WAIVER.

13. Travel Safety Warning: All guests are responsible for checking the travel and entry protocols for the destination that they are travelling to before they depart and ensuring that they fully understand and comply with any such protocols. For example, for some destinations, may require guests to be fully vaccinated and/or to obtain a negative PCR Covid-19 test a certain number of days pre and post travel. The prizewinner is advised to visit the travel.gov website before travel and to check the official Government website for the country visiting. The Sandals Resorts Prize Package provider and/or Sandals Resorts shall not be responsible for any additional costs incurred for any required test or any other pre-travel requirements.

14. Use of Personal Data/Personal Information: Entry into the Sweepstakes constitutes the Participants’ representation of eligibility, consent to participate and consent for the Sponsor to obtain, use and transfer your name, mailing address, email address and other information obtained through the entry for the purpose of the Sweepstakes administration and Prize redemption. The Sponsor’s Privacy Policy is available here https://www.bigmachinelabelgroup.com/privacy/ and the Sandals Prize Provider’s Privacy Policy is available here https://www.sandals.com/general/privacy/. All Participants who “opt-in” to receive future communications from the Sandals Prize Provider regarding marketing promotions, special savings and event notifications about Sandals Resorts will have the ability at any time to opt out of receiving any future marking promotions or events.
